Barbara Grutter is a white Michigan resident with a 3.8-grade average and was denied admission to the University of Michigan Law school, which she sued in a district court claiming racial discrimination against her in violation of the fourteenth amendment on the basis that race was considered a direct factor in the admission process. Based on my ruling, if a race is tailored to the compelling interest of diversity, and if a holistic process was employed in evaluating each applicant, then race as one factor in admissions policy does not violate the equal protection clause of the fourteenth amendment.

After reading the court findings, the ruling was similar since they held that diversity was a compelling interest that could justify the narrowly tailored use of race when public universities select applicants for admission. The ruling was correct with the reasoning that universities are mandated not to establish quotas for certain racial groups or put the embers on a separate admission track; neither are they insulated from competition for admission. In particular, the Law school’s goal of attaining a critical mass of underrepresented minority students does not transform the program into a quota.
